Why is there a license for public data?

Not a Creative Commons license. This is Civic Forge Solutions LLC’s own license for reuse of data made available through atltransit.live. It incorporates and adapts substantial terms from the Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0) Public License, together with amendments specific to this Service. Creative Commons has not reviewed, approved, or endorsed these amendments, and this document is not itself a Creative Commons license and may not be described as one. See Section 10 below.

Effective Date: August 6, 2026

This ATL Transit Live Data License 1.0 (this “Data License”) governs your use of transit data that Civic Forge Solutions LLC (“CFS,” “we,” “us,” or “our”) makes available for reuse through atltransit.live (the “Service”), including via any public API or downloadable dataset we publish, except where we expressly state that different terms apply at the point of access. This Data License supplements, and should be read together with, our Terms of Service, including its disclaimers, limitation of liability, and governing-law provisions, which continue to apply to your use of the Licensed Data.

1. Definitions

“Licensed Data” means the aggregated or processed transit data (such as arrival predictions, schedules, route information, statistics, or service alerts) that we make available for reuse through the Service, including via a public API or downloadable dataset, where we have not stated that different terms apply at the point of access. Licensed Data does not include the Service’s own software, design, text, graphics, or logos, which remain governed by Terms of Service Section 6.1.
“Adapted Data” means data derived from or based on the Licensed Data that translates, alters, arranges, transforms, or otherwise modifies it in a way that would require CFS’s permission as the rights holder.
“Share” means to make the Licensed Data or Adapted Data available to others by any means, including reproduction, distribution, public display, or making it available for on-demand access.
“NonCommercial” means not primarily intended for, or directed toward, commercial advantage or monetary compensation, as further defined and limited by Section 4 (Commercial Use) below.
“You” means the individual or entity exercising the rights granted by this Data License.

2. License Grant

Subject to the terms and conditions of this Data License, we grant You a worldwide, royalty-free, non-sublicensable, non-exclusive, irrevocable license to:

reproduce and Share the Licensed Data, in whole or in part, for NonCommercial purposes; and
produce, reproduce, and Share Adapted Data, for NonCommercial purposes.

This license applies to any media or format now known or later created, and permits the technical modifications necessary to exercise these rights in that media or format. Nothing in this Data License grants You any right to use CFS’s or MARTA’s trademarks, trade names, or logos, and nothing in this Data License implies that CFS or MARTA sponsors, endorses, or is affiliated with You or Your use of the Licensed Data. Patent rights, trademark rights, and moral rights are not licensed under this Data License. To the extent CFS has any database or other sui generis rights in the Licensed Data, this Section 2 licenses those rights to the same extent, and for the same NonCommercial purposes, as the rest of the Licensed Data.

3. Attribution

If You Share the Licensed Data or Adapted Data, You must give reasonable credit to atltransit.live, including:

a reasonably prominent identification of atltransit.live as the source (for example, “Data from atltransit.live” or an equivalent credit visible to end users of Your app, site, or product);
a link to this Data License or to atltransit.live, where reasonably practicable; and
an indication of any modifications You made to the Licensed Data, if You Share Adapted Data.

You may satisfy these conditions in any reasonable manner appropriate to the medium in which You Share the Licensed Data or Adapted Data; for example, a link on an “about” or “credits” page or screen is generally sufficient for an app.

4. Commercial Use

Publishing an app on an app store that uses Licensed Data, and/or charging for use of such an app, is a commercial use and is not covered by the NonCommercial license in Section 2. Commercial use of the Licensed Data requires a separate license agreement with CFS. Contact us at [email protected] to discuss one.

5. Academic and Journalism Use

Notwithstanding the NonCommercial restriction in Section 2, we permit use of the Licensed Data for bona fide academic research and journalism, including by researchers or journalists affiliated with a commercial university, publisher, or media organization, provided the Licensed Data itself is not resold, relicensed, or repackaged as a standalone commercial product, dataset, or API. Academic and journalistic use remains subject to the attribution requirement in Section 3. We reserve the right to ask for reasonable confirmation of an academic or journalistic use, and to revoke this permission if we determine, in good faith, that it is being used to work around the commercial-licensing requirement in Section 4.

6. Underlying MARTA Data

The Licensed Data is derived, in whole or in part, from data feeds and public alert channels published by the Metropolitan Atlanta Rapid Transit Authority (“MARTA”). Nothing in this Data License grants You any rights in that underlying MARTA data beyond what CFS itself has the right to grant. Underlying MARTA data remains subject to any terms MARTA itself imposes on its public feeds, independent of this Data License.

7. Disclaimer of Warranties and Limitation of Liability

The Licensed Data is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. This Data License does not expand, and should be read together with, the disclaimers in Terms of Service Section 8 and the limitation of liability in Terms of Service Section 9, both of which apply to Your use of the Licensed Data.

8. Term and Termination

This Data License applies for as long as CFS has rights in the Licensed Data. If You fail to comply with this Data License, Your rights under it terminate automatically, but will be reinstated automatically as of the date You cure the violation, provided You do so within 30 days of discovering it, or upon our express reinstatement. CFS may also stop making the Licensed Data available, or offer it under different terms going forward, at any time; doing so does not, by itself, terminate a license already granted to You for Licensed Data You obtained before that change.

9. No Additional Restrictions

We are not bound by any additional or different terms or conditions You communicate to us unless we expressly agree to them in writing. Any separate agreement between You and CFS regarding the Licensed Data (such as a commercial license under Section 4) is independent of this Data License and controls only to the extent it conflicts with this Data License.

10. Relationship to Creative Commons

This Data License is Civic Forge Solutions LLC’s own license. It incorporates and adapts substantive terms from the Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0) Public License published by Creative Commons Corporation, together with amendments specific to this Service (Sections 4 through 6 above, and the definitions and clauses that support them). Creative Commons does not assert copyright in the text of its licenses and permits this kind of adaptation, but its published guidance is clear that a modified license may not be called, labeled, or described as a “Creative Commons” or “CC” license, and that the Creative Commons name, logos, and other trademarks may not be used in connection with a modified license. In keeping with that guidance:

This Data License is not a Creative Commons license, has not been reviewed, approved, or endorsed by Creative Commons Corporation, and — because its terms differ from unmodified CC BY-NC 4.0 — may not be compatible with unmodified CC BY-NC 4.0-licensed material for combination or remixing purposes.
We do not use the Creative Commons name, “CC,” or the Creative Commons logos or buttons to describe or label this Data License.
Data previously described as available “under CC BY-NC 4.0” through the Service is, as of the Effective Date above, available under this Data License instead.

11. Interpretation

If any provision of this Data License is found unenforceable, it will be reformed to the minimum extent necessary to make it enforceable, or severed if it cannot be reformed, without affecting the rest of this Data License. No term of this Data License is waived, and no failure to comply is excused, unless we expressly agree to it in writing. This Data License does not reduce, limit, or restrict any use of the Licensed Data that would be lawful without it (for example, under fair use).

12. Changes to This Data License

We may update this Data License from time to time. If we make material changes, we will update the “Effective Date” above and provide reasonable notice, such as a notice on the Service. Changes apply prospectively to Licensed Data accessed after the change takes effect; they do not revoke the license already granted for Licensed Data You obtained before the change, for as long as You continue to comply with the version of this Data License that applied when You obtained it.
